Social Media Policy

The use—and potential abuse—of social media networking tools creates challenges for employers. While the law is in flux and definitive legal guideposts are evolving, employers can protect their legal rights and interests through use of a personnel policy on social media.

A policy that defines appropriate use, integrates the requirements with other key employer policies (e.g., antiharassment), and disclaims employer responsibility for unauthorized social media activity is an employer's best compliance mechanism to control and manage its legal risks, exposures, and interests. ASA members may access the following sample template policies, prepared by Seyfarth Shaw LLP, which address social media networking issues. Download a Word document (DOC 216 KB).

These policies are not intended as legal advice. They provide suggested language only, and modification may be necessary or desirable in particular cases. Before using these policies or any of their provisions, staffing firms are strongly urged to seek the advice of competent legal counsel.
